So Justin’s in California

30 May

From WABI

Ayla was reported missing from a home in Waterville by her father, Justin DiPietro, in December 2011.

State police launched a massive search for Ayla and later said they believed she was dead.

According to documents on file on the Cumberland County Probate Court website, DiPietro now lives in California.

No charges have ever been filed in Ayla’s disappearance.

Poor Ayla Bell, this is still going on !

Everyday Trista wakes up to the truth that Ayla is gone. And she has been sentenced to whatever her imagination tells her happened to Ayla under Justin’s care. So far no Ayla and no answers.

How Justin and all those involved do this over and over every day?

Ayla deserves justice in her name ! Trista needs justice for her baby and for what has happened to herself. This has been Trista’s young adult hood – fear and torture.

It was said a while back that Justin’s father lived in Cally. I am guessing Justin has his dad or other family out there. Does the border conveniently play a part. I think Justin can forget that as a way out. Because they will send Justin back !!!! Sounds like Phoebe is behind this and is still playing games with peoples lives. If Justin is still listening to Phoebe – and he runs – it will only make things worse for everyone including himself.

    From Press Herald

Ayla was 20 months old when she was reported missing from her grandmother’s house at 29 Violette Ave. in Waterville on Dec. 17, 2011. She was staying there with DiPietro, his then-girlfriend, Courtney Roberts, and his sister, Elisha DiPietro.

Police don’t believe she is alive and have said they think foul play was involved in her disappearance, but there have never been any charges in the case.

The statute of limitations for filing a wrongful death lawsuit is six years after the five-year anniversary of when a person is reported missing, which in this case would be in December 2022.

A hearing before a probate judge to determine if a person is legally dead is usually a short proceeding that involves the personal representative telling the judge the last time he or she saw the missing person and producing affidavits, newspaper stories and other information about the case, said Jim Burke, a criminal lawyer and clinical professor at the University of Maine School of Law. Burke has no inside knowledge of Ayla’s case and wouldn’t comment on specifics.

A wrongful death lawsuit is a civil lawsuit in which a plaintiff tries to prove someone caused another’s death. The plaintiff’s lawyer is entitled to get discovery from the other side and can ask the defendant questions under the rules of civil discovery, Burke said.

“He can choose not to answer, and if he does that they can’t compel him to answer, but they’d probably ask the court to draw a negative inference,” Burke said.

    DISAPPEARANCE STILL INVESTIGATED

In a civil case, if the defendant is found liable for wrongfully causing the death of another, the punishment is monetary damage, Burke said, and there are rules for how pain and suffering and other damages are calculated.

“The plaintiff’s lawyer will try to get the highest figure they can, and the defendant will try to get zero,” said Burke, who has been a criminal lawyer for 41 years and a law professor for 15.

I remember reading that Phoebe lived close to 29 Palms marine base and that’s where she might have met Justin’s dad.
Also, people might not connect him as Ayla’s dad in California. I’m sure it was hard to get a job or even a date in Maine.
I don’t know if this will lead to the answers Trista needs or not. I hope it does.
Most people must think he is guilty of removing Ayla however she died. If he moves to Mexico they may never get him or answers.

Even if he stays in California, how difficult would it be to get him to return for a civil suit verses criminal? I know of civil cases where the defendant just didn’t show up and the plaintiff won the case.

I assume everyone involved will have to testify.

Regardless of who is called to testify, there’s a high probability of them taking the 5th.

I’m almost positive none of them would show up for a wrongful death suit. I hope Trista still includes Courtney when she files.

I bet Justin just does not appear in court. So, then a question I would ask the attorney is can others be sued in this case? Phoebe, Elisha, Courtney and even Derek?
How far does their responsibility go?
If Trista wins the case against Justin, will that get her anything she really wants? Answers? Money?
I hope she can include others as defendants as well as witnesses.

He won’t this time, not if it is a choice.

I will wait the two or so weeks. But I really hope they all get sued! And I really hope Ayla’s ongoing care is included if possible.

Anyone else notice that Justin says he was employed since 2009, yet he was unemployed when Ayla went missing and was going to truck driving school just before….he is so honest!

    Excellent article.

Bill Nemitz: An appeal to Ayla’s killer: Listen to your conscience

Perhaps the news that her mother is seeking to have the toddler declared dead will trigger remorse in whoever removed that smiling face from this world.

She’s back. More than five years after 20-month-old Ayla Reynolds vanished without a trace, there she was Wednesday once again on the front page, smiling back at a world she no longer inhabits.

Somewhere out there, we can only hope, that photo is driving someone insane.

I understand the comments are practical and reasoned. Hopefully all can be sued and one person may consider talking might be in their best interest as opposed to financial consequences. ms.p

Somehow, I would be surprised if the Dipietro’s say anything. I agree, they may take the 5th. Elisha has said a few new things, though. And if they don’t say anything, they may end up paying Trista.
I hope they call everyone who was at the house or with any of the Dipietros that week as witnesses.
You never know when someone will say something that helps.
I hate that Ayla is in an unknown place.

It’s 2017, and it has been 2017 days since Ayla was reported missing.

2017 days. Unacceptable ! And that her own father did what with her is still the question? Justin Dipietro, Where is Ayla Bell Reynolds?

Social Services who never checked on Ayla’s safety, not even once after a Social Worker authorized and told the police to take Ayla and give Ayla to Justin Dipietro a brand new father in her life, (while her full time mother was away for just a couple weeks.) That was so unfair to Ayla and her well being. Just Evil ! Evilness ! Ayla is the one who paid with her own safety and life ! Heads and jobs should have rolled and flown at the Dept that did this to Ayla. Cold heartedness to the core. Ayla was and is a human being !!!!!!!!! Someone casually took a very young not capable of language child and gave her away to someone who up till that very moment did not want her. And probably still did not want her.

A selfish evil Grandma Dipietro !. Did she ever reassure Ayla’s mother or maternal family that Ayla was loved and well taken care of in her home? She screamed hate at the ‘mother with a missing baby girl’ from Phoebe’s very own home!!! Phoebe is the very definition of a hateful nasty evil grandmother. It does not matter how much Phoebe heaps love on the granddaughter who is still alive, She is still a hateful nasty evil excuse of a grandmother for not making her home a good and at a minimum safe home for Ayla to at least survive there. Ayla was there because Phoebe took advantage of Trista being away and then she kidnapped Ayla with the help of a social service worker. Now over 2017 days.
